항소심에서 ‘유전무죄’ 논란 속에 집행유예로 풀려난 정몽구 현대·기아차그룹 회장이 검찰의 대법원 상고제기로 다시 위기를 맞고 있다. 돈이 많은 사람은 돈으로 사회에 봉사할 수 있다는 취지의 ‘사회봉사명령’이 대법원에서 위법한 결정으로 결론이 날 경우 정회장은 다른 형태로 ‘죗값’을 치러야 한다. 법조계에서는 사회봉사명령이 파기될 경우 이의 이행을 전제로 선고된 집행유예 자체의 법적 효력도 원점에서 다시 따져봐야 한다는 지적도 나오고 있다.
서울고법 형사10부는 지난 6일 정회장에 대해 징역 3년에 집행유예 5년을 선고하면서 8400억원의 사회공헌기금을 포함해 1조원 상당의 사재 출연 등 이례적인 사회봉사를 명령했다. 재산출연도 사회봉사명령의 한 형태가 될 수 있다는 항소심재판부의 판단에 대해서는 법조계 내에서 부정적 의견이 적지 않다.
사실상 사회봉사명령이 벌금형을 대신하는 변형된 주문으로 활용되면서 화이트칼라범죄에서 실형선고율이 급격히 낮아질 소지가 있다는 것이다.
검찰 측은 지난 10일 “재산사회환원과 같은 사회봉사명령은 현행법에 근거가 있다고 보기 어려워 죄형법정주의에 위반되고 위헌소지가 있다”면서 상고이유를 제기한 바 있다. 현행 대법원 예규도 사회봉사명령을 자연보호, 복지시설 등 기타 지역사회에 유익한 공공분야 봉사활동 등으로 예시하고 있어 몸 대신 돈으로 때우는 사회봉사명령은 사실상 상정을 하지 않고 있다.
대법원이 사회봉사명령을 폭 넓게 해석해 ‘법리에 문제가 없다’고 판단한다면 항소심 판결이 그대로 확정될 수 있다. 하지만 ‘법리 판단에 문제가 있다’는 점을 인정한다면 문제는 달라진다.
항소심 재판부는 정회장에 대한 선고 직후 “(통상의 양형판단 요소만으로는) 집행유예 선고가 부족한 점이 있어 사회봉사명령을 내린다”고 밝힌 바 있다. 사실상 재판부가 ‘향후 5년간 매년 1200억원의 사회공헌기금 출연’이라는 사회봉사명령의 이행을 전제로 ‘조건부 집유’를 선고한 것임을 시사한 것이다.
따라서 대법원이 사회봉사명령을 파기할 경우 이를 전제로 한 집행유예의 효력도 문제가 될 수 있다. 파기환송심에서 ‘실형’이냐, ‘집행유예’냐를 놓고 다시 재판부가 형을 정하는 상황이 발생할 수도 있다는 것이다.
